Technically not. Since it's was Van who decided to completely rearrange their homes, and force trillions of gallons of their land into a new lake.
So it's technically their land (the water), and Van's fault for not making sure there were no sentient beings in the River when he did his 24 hr Irrigation Rush Project.

as someone doing a bachelor degree in Maritime Transport and Nautical Science i can tell you that the amount of water in that lake is nothing and would have no effect on them and that sea borders goes on the seafloor not water
