So, if he were to directly kill him, Desmond or someone else could raise a fuss and the territory could be confiscated by the King, who would then allocate it to a magistrate until a proper investigation was done to find the rightful heir. If the people rise up because of poor governence, if the familial inheritor settles the dispute, he is immediately instated as the new governing body.
He got the common people, who hated him, to kill him; in front of him. They didn't have farm equipment to not use it, it was just done off screne. He didn't kill him because he couldn't be for his plan to be carried out appropriately.
